GENERAL TERMS AND CONDITIONS OF SALE
Terms and Conditions: only the Dutch version of this text is legally binding
Article 1 – 1.1 In these general terms and conditions of sale, the following definitions apply:

Webshopinterieur or www.stylish.luxury refers to: BV Marcottestyle, a private limited company established at 2950 Kapellen, Marcottedreef 20, with company number BE 0880.453.459. Hereinafter referred to solely as Stylish.
Customer: any third party who wishes to purchase or has purchased a product from Stylish BV via the webshop www.stylish.luxury or via a project file, which includes the sale of furniture and related products.
Agreement: any sales agreement (including through project files) concluded between Stylish as seller with VAT number BE0880.453.459 and the Customer as buyer, and any amendments or additions thereto, unless stated otherwise.
Product: a product offered for sale by Stylish on the Website, via a project file, or by email.
Terms of Sale: these general terms and conditions of the Webshop, as available at https://www.stylish.luxury, are supplementary to the general terms and conditions of sale of BV Stylish, available at https://www.marcottestyle.com/algemene-voorwaarden/, and vice versa, unless stated otherwise.
Website: the website https://www.stylish.luxury and all other websites owned by Stylish with different URLs that redirect to this website and have similar content.
These Terms of Sale form part of every agreement and apply to all legal actions by Stylish BV and the Customer in the execution of any agreement, unless stated otherwise.
Deviations from and/or additions to any provision in an Agreement and/or these Terms of Sale shall only be valid if agreed upon in writing and shall apply exclusively to the specific Agreement.

Article 7. Force Majeure and/or Exceptional Circumstances:
Stylish is not obligated to fulfill any obligations towards the customer if hindered due to circumstances beyond its control, which are not attributable to Stylish under the law, a legal act, or common opinion. Such circumstances include but are not limited to: malfunctioning of the website, email servers, or internet traffic disruptions.
Article 8. Assortment:
Stylish reserves the right to change or remove any product or component from its assortment at any time.
Article 9. 2-Year Warranty:
Goods purchased from Stylish come with a 2-year warranty against manufacturing defects, provided a purchase receipt can be presented. Some manufacturers may only offer a 1-year warranty. For professional use, warranty is always limited to one year. Most products distributed by Stylish are handmade, which may result in minor differences in color, finish, or size. Visible complaints must be noted upon delivery to the transporter on the delivery document (CMR). Hidden defects must be reported in writing within 48 hours of delivery.
Article 10. Warranty Conditions:
10.1 Up to 2 years after delivery: repair or replacement costs are covered by the manufacturer. Transport and call-out fees are the responsibility of the customer: €65 per 0.20m³ nationally, and €125 per 0.20m³ internationally. For products under 0.25m³, the same costs apply.
10.2 Breakage of glass or ceramics, wear and tear, and damage caused by non-household or improper use are excluded from warranty.
10.3 The right to replacement does not apply if the defect can reasonably be repaired.
10.4 The customer must return the goods to Stylish or the manufacturer at their own cost and risk, provided the return is approved.
10.5 If a returned product shows damage caused by the customer, repair and transport costs will be charged to the customer.
10.6 Velour chairs may show compression marks due to packaging. Fabrics may flatten due to heat, weight, or moisture. This is not a valid reason to reject the product. To fix, place a lightly damp cloth on the area for 30 minutes, then brush with a velvet or nubuck brush in the direction of the nap and allow to dry. Do not rub the fabric, as this will make it dull.
10.7 Product lifespan may vary depending on care. Factors such as harsh cleaning agents, pets, or exposure to sunlight can reduce durability, especially in fabrics or faux leather. Stylish is not liable for such damage. Scratches from metal accessories (e.g. jeans buttons) and pet damage are the customer's responsibility.
Article 11. Liability and Indemnification:
11.1 Stylish is only liable for damage to the customer or third parties caused by intent or gross negligence, or due to circumstances for which Stylish is legally responsible. Stylish is not liable for consequential or business losses, indirect damages, or loss of profit or enjoyment.
11.2 Stylish is not liable for damage or injury resulting from use of the product or packaging, or for any shortcoming by Stylish, its employees, or third parties it engages.
11.3 In any case where Stylish is held liable, the liability is limited to the amount the customer paid for the product.
Article 12. Intellectual Property Rights:
12.1 The customer explicitly acknowledges that all intellectual property rights related to the products offered by Stylish (including copyrights and design rights) belong to Stylish, its suppliers, or other rights holders.
12.2 The customer is prohibited from using or reproducing these intellectual property rights without prior written permission from Stylish, its suppliers, or other rights holders.
Article 13. Disputes:
13.1 Belgian law exclusively governs the Agreement and these Terms of Sale, with the exclusion of the Vienna Sales Convention (CISG).
13.2 Disputes between the customer and Stylish regarding the formation or execution of agreements may be submitted by either party to the Disputes Committee, if Stylish is a member of the committee.
13.3 The Disputes Committee will only handle disputes if the customer has first submitted the complaint to Stylish within the specified period.
13.4 The dispute must be submitted to the Disputes Committee in writing within three months after the complaint was submitted to Stylish.
13.5 If the customer wishes to submit the dispute to the Disputes Committee (as stated in 13.2), Stylish is bound by that choice. If Stylish wishes to submit the dispute to the Disputes Committee, the customer must confirm within five weeks whether they also wish this. If the customer does not respond within five weeks, Stylish is entitled to bring the dispute before the competent court.
13.6 The Disputes Committee issues binding decisions in accordance with its regulations.
Article 14. Promotional Conditions for the Webshop (https://www.stylish.luxury):
14.1 All offers are limited to two items per customer unless stated otherwise.
14.2 Offers are valid while supplies last.
14.3 Promotions cannot be combined with other offers.
14.4 All promotions are valid for one day unless otherwise stated.
14.5 Discounts do not apply to gift cards.
14.6 Promotional items cannot be reserved during promotions. Promotions do not apply to outlet items.
Article 15. Website Information:
Although this website is maintained with the greatest care, no rights can be derived from or claims made regarding the accuracy and completeness of the content. All product information, prices, dimensions, and shipping costs are subject to change. We reserve the right to correct incorrect or incomplete information related to product descriptions, dimensions, prices, and shipping fees. All dimensions are approximate due to the handmade nature of most products.
Article 16. Legal Validity and Language:
Only the Dutch version of these terms and conditions is legally binding. Versions in other languages are free translations and therefore not legally binding. If necessary, only the courts in Antwerp have jurisdiction.
